Instructor Policy

Welcome to Nanotech Academy, a division of Best Nanotech Pvt Ltd. When you register as an instructor on our platform at www.nanotechacademy.in, you agree to abide by these Instructor Terms (“Terms”). These Terms are incorporated by reference into our Terms of Use and govern your relationship with us as an instructor. Any capitalized terms not defined here have the meanings specified in our Terms of Use.

As an instructor, you are contracting directly with Best Nanotech Pvt Ltd through its division Nanotech Academy, registered under Indian law with jurisdiction in Delhi, India.

1. Instructor Obligations

As an instructor, you are fully responsible for all content you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements (“Submitted Content”).

You represent and warrant that:

You will provide and maintain accurate account information

You own or have necessary licenses, rights, consents, permissions, and authority to authorize Nanotech Academy to use your Submitted Content as specified in these Terms

Your Submitted Content will not infringe or misappropriate any third party’s intellectual property rights

You have the required qualifications, credentials, and expertise to teach semiconductor-related subjects through your Submitted Content

that corresponds with semiconductor industry standards

You warrant that you will NOT:

Post inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libelous content

Post unsolicited advertising, promotional materials, junk mail, spam, or other unauthorized solicitation

Use the Services for business other than providing semiconductor education and training services to students

Engage in activities requiring us to obtain licenses from or pay royalties to third parties

Frame or embed the Services or otherwise circumvent our platform

Impersonate another person or gain unauthorized access to another person’s account

Interfere with other instructors or abuse Nanotech Academy resources

2. Content Licensing and Intellectual Property

License to Nanotech Academy:

You grant Nanotech Academy the rights detailed in our Terms of Use to offer, market, and exploit your Submitted Content. This includes the right to add captions or modify content to ensure accessibility, and sublicense these rights to students directly and through third parties such as resellers, distributors, affiliate sites, and advertising platforms.

Educational Use Compliance:

In accordance with Section 52 of the Indian Copyright Act, 1957, you acknowledge that your content may be used for legitimate educational purposes including reproduction by teachers or pupils in the course of instruction. You must ensure all third-party content used in your courses complies with Indian copyright law and fair dealing provisions.

Retention of Ownership

Unless otherwise agreed, you retain the right to remove all or any portion of your Submitted Content from the Services at any time. However, rights given to students before removal will continue in accordance with the terms of those licenses, and our right to use such content for marketing purposes shall survive termination.

3. Revenue Sharing and Payments

Revenue Share Model:

When a student purchases your course, we calculate the gross amount as the amount actually received by Nanotech Academy (“Gross Amount”). From this, we subtract:

Any applicable taxes under Indian law

A 3% service and processing fee for non-mobile transactions

Mobile platform fees where applicable

Any amounts paid to third parties in connection with promotional programs

This results in the Net Amount, of which your revenue share will be 37% unless you participate in promotional programs that may offer different rates.

Enhanced Revenue Share:

For sales occurring through your own coupon codes or referral links, you receive 97% of the Net Amount.

Payment Processing:

All instructor payments are made in Indian Rupees (INR) in compliance with Indian foreign exchange regulations. Payments are processed within 45 days of the end of the month, provided the amount payable is at least ₹1,000. Smaller amounts are held until reaching this threshold or paid by year-end.

4. Compliance with Indian Law

Legal Framework:

These Terms are governed by the laws of India, including the Information Technology Act, 2000, Indian Copyright Act, 1957, and applicable regulations. All disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India.

Educational Content Standards:

Your content must comply with Indian educational standards and the guidelines established by regulatory bodies for technical education. Content related to semiconductor technology must be accurate, current, and aligned with industry best practices.

Tax Compliance:

You are responsible for complying with Indian tax laws, including GST registration if applicable. We will provide necessary documentation for your tax filings, including TDS certificates where required.

5. Quality Standards and Review Process

Content Quality Requirements:

All courses must meet minimum quality standards including:

At least 30 minutes of video content

Minimum 5 lectures or learning modules

Semiconductor-specific learning objectives

Industry-relevant practical exercises or labs

Clear course descriptions and outcomes

Review Process:

New courses undergo a quality review process to ensure compliance with our standards and Indian educational guidelines before publication.

6. Instructor Code of Conduct

Professional Standards:

You agree to maintain the highest professional, ethical, and legal standards in all interactions with students and the Nanotech Academy community. This includes:

Timely response to student queries (within 48 hours)

Professional communication in all forums

Respect for diverse backgrounds and learning needs

Adherence to scheduled class timings for live sessions

Prohibited Activities:

Criminal or harmful conduct that could negatively impact user trust

Hateful or discriminatory conduct or speech

Spreading disinformation or misinformation

Soliciting students for off-platform business without authorization

7. Co-Instructors and Teaching Assistants

You may add co-instructors or teaching assistants to your courses, subject to our approval. You remain responsible for their actions and any violations of these Terms by co-instructors or assistants may impact your account. Revenue sharing with co-instructors will be deducted from your earned share based on ratios you specify.

8. Anti-Piracy and Content Protection

We partner with anti-piracy vendors to protect your content from unauthorized use. You hereby appoint Nanotech Academy and our vendors as your agents for enforcing copyrights through notice and takedown processes under applicable Indian copyright laws.

9. Promotional Programs and Marketing

Promotional Participation:

You may opt into promotional programs that allow us to offer your courses at discounted prices to increase enrollment and revenue potential. These programs are governed by our separate Promotions Policy.

Marketing Rights:

You grant us permission to use your name, likeness, voice, and image in connection with marketing our Services and your content, subject to applicable Indian laws regarding personality rights.

10. Account Management and Termination

Account Deletion:

You may delete your instructor account following the process outlined in our Help Center. We will use commercially reasonable efforts to make remaining scheduled payments before account deletion.

Termination by Nanotech Academy:

We reserve the right to remove content, suspend payouts, and/or ban instructors for any reason, including:

Non-compliance with policies or legal terms

Content falling below quality standards

Behavior reflecting unfavorably on Nanotech Academy

Engaging services of marketers who violate our policies

11. Limitation of Liability and Indemnification

Limitation of Liability:

To the maximum extent permitted by Indian law, Nanotech Academy’s total liability for any claim shall not exceed the fees you earned in the 12 months preceding the claim.

Indemnification:

You agree to indemnify Nanotech Academy against any claims arising from your use of student personal data or violation of these Terms.

12. Updates and Modifications

We may update these Terms from time to time to reflect new practices or legal requirements. Material changes will be communicated via email or platform notice with 30 days’ advance notice. Continued use of our Services after changes become effective constitutes acceptance.

13. Governing Law and Dispute Resolution

These Terms are governed by Indian law with exclusive jurisdiction in Delhi courts. You agree to first attempt informal resolution by contacting support@nanotechacademy.in before pursuing formal legal action.
